GENERAL PROVISIONS
The following terms and conditions of sale together with our Privacy Policy and other terms and conditions and policies made available on the Le Labo Australia website (the "Site") (collectively, the "Terms and Conditions") apply to the offer and sale of products through the Site.
To be eligible to purchase products on the Site a customer must:
- be at least 18 years old or, if a minor, be duly authorized by their legal representative;
- be a consumer, meaning a natural person acting for purposes extraneous to their trade, business, craft and profession; and
- hold a valid credit card.
IDENTIFICATION OF THE VENDOR
Estee Lauder Pty Ltd. (ABN 63 008 444 719), an affiliate of The Estée Lauder Companies Inc., with its business address at Level 24, 201 Elizabeth Street, Sydney NSW 2000, Australia ("we", or "us" or "our") is the supplier of the goods for this Site.
PRODUCTS
We take all reasonable care to ensure that all details, descriptions, images of products appearing on the Site are correct at the time when the relevant information was entered onto the system; however, on rare occasions, the details, descriptions, images of products available on the Site may not be accurate, complete, reliable, current, or error-free. If the customer has placed an order and we become aware of any such inaccuracy or error in respect of the products, or if the products received are defective or do not conform to the applicable order, customers are advised to contact us via melbourneestore@lelabofragrances.com to arrange a replacement or refund (including Shipping fees).
Please note that we do not accept returns nor exchanges except for under clause 9, or if the product does not conform to your order.
The products described on the Site, and any samples thereof we may provide to the customer, are for personal use only. Customers may not sell or resell any of these products or samples thereof.
We reserve the right (acting reasonably), upon written notice, to cancel or reduce the quantity of any products or samples to be provided to the customer that may result in the violation of these Terms and Conditions. If we cancel an order, we will promptly re-imburse to the customer any amount paid in respect of the order. In the event of a reduction or variation in the quantity of an order, the customer will only be charged for the price of the products which are the subject of the varied order.
PRICES
All prices indicated for products available via the Site are inclusive of GST at the current rates and are expressed in Australian Dollars (AUD). Delivery charges (if applicable) shall be added to the price of the products and are indicated separately on the order form. For further information please also visit the Shipping & Returns section of the Site.
We regularly verify that all the prices displayed on the Site are correct, however, on rare occasions, prices displayed on the Site may not be accurate. In the event that an error in the pricing of a product is detected, we will offer the customer the opportunity to purchase the product at the correct price or to cancel the order. If the order is cancelled by the customer, we will promptly re-imburse to the customer any amount paid in respect of the order.
PLACING AN ORDER
We limit orders to eight (8) of any single item and fourteen (14) total items. These restrictions may be applicable to orders placed by the same account, the same credit card, and also to orders that use the same billing and/or shipping address. Orders exceeding these limits will not be accepted and are subject to cancellation. We will provide written notification to you should such limits be applied. Customer must click "Add to cart" to place the product selected in the desired quantity in the shopping cart. At any time while shopping a customer may review the products in the shopping cart by clicking on "Checkout" on each page.
Customer must follow the onscreen instructions to proceed through the checkout process. The customer may always correct any errors in data he/she has entered, change the shopping cart contents, by adding or removing one or more products from the shopping cart, or cancel the entire order during checkout before sending his/her order. By submitting an order, the customer acknowledges and declares that he/she has read all the instructions provided during the checkout process and fully accepts and agrees to these Terms and Conditions. The customer places an order request for products via the Site by clicking on the Submit button at the end of the order process.
After an order has been submitted, a "Thank You" page will be displayed, and the customer will receive shortly an email confirming receipt of the order.
If an order confirmation does not arrive within 24 hours after submission, customer may contact us at concierge@lelabofragrances.com for assistance.
If customers have any questions or concerns when placing an order or if they wish to enquire about a previously placed order, they may contact us via email at the following address concierge@lelabofragrances.com. For fastest service, customers are invited to keep their order number available.
PAYMENT OPTIONS
Customers may pay for the products by credit card. The following credit cards are accepted for payments:
- Visa
- MasterCard
- American Express
We do not accept credit cards with billing addresses outside of Australia.
Transactions will be settled upon shipment of order, however a pre-authorization will be held once order is placed.
For customer's security, customer's billing name and address must match that of the credit card used for payment. We reserve the right to cancel any order that does not match these criteria.
All credit card holders are subject to validation checks and authorization by the credit card issuer. If the issuer of customer's payment card refuses or does not, for any reason, authorize payment to us, whether in advance or subsequent to a payment, we may cancel the order by written notice to the customer and will not be liable for any delay or non-delivery.
ORDER INQUIRIES
Orders are processed within the timeframes set out in the Shipping & Returns section of the Site. For any shipping information customers may contact us via email at the following address: concierge@lelabofragrances.com.
Registered customers can check the status of their most recent orders by visiting the Order History page upon login. Customers who checkout as guest can see the status of their most recent orders in their order confirmation email.
When the customer clicks on the Log In/Register button, he/she will be prompted to log in with his/her email address and password. An account history page will provide the customer with detailed information about his/her current and past orders. After an order is shipped, the relevant tracking number, if available, will be displayed. Customers can track the delivery status of the order with our courier by clicking on "View tracking info" on the order summary. Some carriers may not have tracking information available for up to 24 business hours after the order is shipped.
Occasionally, orders or parts of an order are cancelled by our system for various reasons. Some reasons are:
- Item(s) not available
- Impossibility in processing payment information
- Cannot deliver to address provided
- Duplicate order was placed
- Cancellation due to a customer request
- Breach or violation of these Terms and Conditions
If an order is cancelled, the customer will receive an email to explain the reason for the cancellation. Customers will not be charged for any cancelled orders. The customer's original payment method will be refunded for the appropriate amount. If the customer is interested in placing a new order or if the customer has any questions about a cancelled order, he/she may contact us via email at the following address: concierge@lelabofragrances.com.
The customer cannot change, add to or cancel an order once it has been confirmed by us in accordance with clause 5.4. However, this will not affect the customer's rights to return products in accordance with clause 9.
DELIVERY
Orders are processed and delivered on working days only (Monday through Friday, excluding public holidays). Orders placed on Saturday and Sunday or a public holiday will be processed on the following working day.
- All orders will be shipped by Australia Post, Standard Service only unless the customer requests a different delivery option.
- All orders will be tracked.
We are able to process orders to a P.O Box address.
Shipping charges (if applicable) shall be paid by the customer and are indicated separately on the order form and the delivery note. There are no shipping charges for purchases over the amount we may display on the Site during check out. Details of delivery options and applicable charges can be found in the Shipping & Returns section of the Site.
The products shall be shipped within the timeframes set out in the Shipping & Returns section of the Site, unless we notify the customer, including by email, within the same term, of the ordered products being unavailable, including temporarily unavailable. If the products are unavailable, we may cancel the order in accordance with clause 7.5.
RETURNS
As a consumer, the customer has certain rights under consumer protection legislation, including the Australian Consumer Law ("Consumer Rights"). Nothing in these Terms and Conditions affects or limits the customer's Consumer Rights./
This customer will be entitled (at his/ her election) to a full refund or replacement of the same type of product (if reasonably available) or compensation for the drop in value of the item, if the item:
- is or becomes faulty through no fault of the customer;
- is not fit for a stated purpose or a purpose the customer made known to us;
- does not match our description or sample; or
- has defects that were not obvious, or we did not bring to the customer's attention.
In the case of any other issue with a product, we can choose at our discretion to provide a refund, repair the product or give the customer a replacement product.
Subject to the customer's Consumer Rights, all creations are final sale. Because all Le Labo creations are hand-prepared to order with personalized labels, we do not accept returns nor exchanges except as required by law. If the items sent do not conform to your order, or should they be defective, please email us at concierge@lelabofragrances.com.
APPLICABLE LAW AND JURISDICTION
These Terms and Conditions are governed by the laws of New South Wales.
Any dispute, claim or controversy arising from the interpretation, validity and/or execution of these Terms and Conditions shall be subject to the non-exclusive jurisdiction of the courts of New South Wales.
